My Controversial Justice System

Just a thought...

How about trying something really radical with our justice system in the UK?  Prisons are overcrowded and it doesn't seem to work anyway because so many people reoffend.  You often hear the phrase "The punishment should fit the crime" when people criticise the justice system and that is fine to a dgree but is heavily flawed.  How can you fittingly punish a pedophile under those rules?

The trouble with custodial sentences is that most people who might have been unlikely to reoffend usually end up worse off by influence.  Death penalties are obviosly a problem too because there is always a chance that the person might actually be innocent.

My suggestion is a three strike system that applies to any and every crime.

First time: No sentence.  Just give counselling.  For most casual offenders or those forced to commit crime under difficult circumstances this is more than enough.

Second time: A custodial sentence.  Six months or a year would probably be enough.

Third time: Death penalty REGARDLESS.

Well, what do you think of that?  It would solve a few problems...

Something tells me you would only do it twice at most under that system...  Therefore better all round.

You would have to set some limit, you wouldn't want the death penalty for something like parking violations or littering. Well, maybe...

I know the death penalty seems extreme but it is actually totally logical.  Obviously it is pure logic and compassion doesn't get a look in but think of it this way: If rehabilitation and punishment don't work, what else is left?  Punishing time and time again NEVER works.  If anything it lowers a person's already lacking respect of authority and basically fills up prisons, costing the tax payer lots and lots of money.  No amount of punishment or rehabilitation will cure a habitual criminal and whether they are in or out of prison they are a drain on society in one way or another...  They've already had two chances so eliminate them altogether.

If anyone has a better idea, please come forward!  I suspect my theory is highly flawed but I just haven't seen a suitable argument against it yet...  Believe me, I've tried to think of a few myself...

I don't like the idea of killing someone for a misdemeanour but surely someone committing petty crimes repeatedly is likely to cause problems their whole life.

I think mental health is an important issue here and someone who is mentally ill should be treated differently.  Also maturity is a key factor.  Perhaps this should only apply if you're over 25 or something.  Sometimes going off the rails a bit in your teens to early twenties is just a part of growing up and misdemeanour is often a subsequent part of that.

There's room for improvement there...  There's always room for improvement!

Prison needs to be like prison. They need to take out mid-cons like tv and just have solitary confinement. Just a bed, toilet and 4 grey Walls to hold their thoughts.

Criminals should never be let off for good behaviour.

Some will say 'human rights' but they gave up all their rights when they committe the crime.
